Lawyers with a calm mind: necessity or pun

Updated: Jun 22, 2021

We know that litigation as an art form is never easy for a young lawyer; one needs to persistently challenge themselves with new possibilities to develop. According to an old saying "If you stop learning; you die" and hence we continue to learn. The importance of a calm mind in the life of a successful lawyer is often questioned. Let's go through the qualities of a good lawyer to under to understand if the calmness of mind is a necessity or fib:

  1. Passion: The foremost idea that drives you in this sector and never lets you fail is the passion of being a great lawyer. 'The goal and dream' idea that we have been taught from our young age becomes a great part when you first step in this sector. If you don't know your goals you are bound to be confused and fail, and if you don't know your dream you will fail. So the duo works best when you know the goals and the dream of joining the profession.

  2. Compassion: Unlike doctors we can actually keep ourselves in the position of our clients and imagine the situation. If you are pursuing a degree in law or completed one, you must have read the concept of justice. My teacher taught me the concept of justice stating "what's due to a person", so try delivering what is due to a person and understand what he/she seeks. Compassion is a great value for a lawyer. Compassion towards your clients becomes evident in his/her arguments before the court. The magic happens if you relate, so RELATE.

  3. Communication: The journey is two way, you have to be a better listener than being a good orator. No one says, but few words and strong delivery in the court does the magic. A judge won't say but I can, so I will: "TOO MUCH INFORMATION".... in other words "KEHNA KYA CHAHTE HO".. so litigants keep it short, crisp and sweet. And be as much patient as you can if you are coming in the market, because if you cannot listen you won't be able to retain and specially deliver.

  4. Knowing the law: Now that's the basic... how can you be a part and parcel of something you are unaware of. There can be two kinds of learners - one who know the law and they try to master all at once and the other catergory selects their field of expertise and excel. First ones are regular litigants and the other ones are litigants who are associates of firms, company or businesses. Both are well established and are good options, in former you can actually find more people to interact with and vast learning experience, other one makes you a brand sooner or later.

  5. Legal Creativity : We have to respect the law makers when it comes to practicing it. Everyone who is party to suit, defendants or prosecutors, will always have certain points in their favour. As lawyers, you have to be creative in drafting, cutting short the time, arguments and giving the court what it wants to decide the case. There are various civil and criminal rules that have to be followed which a lawyer of either side should be aware of.

  6. Judgement Skills : With everything aligned, it is very much important for every lawyer to judge what the end of the case is going to be. As a lawyer you really need to know the word "REMOTENESS"... you have to anticipate a situation and work in the direction keeping in mind what all can happen but then the ending always has an open end. You may not necessarily achieve what you aimed.

Now, following all the points above... do you think you can do all this without having a calm mind? Patience and enthusiasm towards the profession follows. Your legal career may be filled with ebbs and tides, "victories and failures", however, with a calm mind it all works out.
